A disagreement between the town authority and Ricardo's parents has been going on for three years in Wallhausen, a small town with a population of 3500. Hartmut and Theodora Schott decided to create a large orange statue of their late son Ricardo and placed it on his grave in the cemetery. However, this led to controversy.
The statue was deemed too big, too colorful, and too gaudy by locals. The town council stepped in and ordered its removal, citing that it was twice the allowable height and that the "signal orange" color was never approved. The council argued that the statue was violating the cemetery's dignity.
Despite the council's order, the statue remains where it was placed in November 2021. The parents took the issue to the administrative court, aiming to overturn the decision. They claimed that they were being treated coldly and insensitively, with the statue helping them cope with their grief. It seems that the acceptance of individual grave designs in Wallhausen hasn't fully materialized.
However, the Stuttgart Administrative Court has made a ruling: the statue must come down! The court reasoned that a cemetery is not just a congregation of individual graves, but a shared resting place for numerous people. While individual grave designs have their limitations, the undisturbed remembrance of the deceased is also prohibited by markers that are intrusive, sensational, or objectively offensive. The statue of Ricardo violates the cemetery's regulations and the burial laws of Baden-Württemberg state.
The parents were not allowed to file an appeal. However, they have now appealed to the Mannheim Administrative Court, requesting that the case be heard.
