Hollywood Casino Joliet sued after fatal crash linked to overserved alcohol
A passenger injured in a car crash is suing Hollywood Casino Joliet in Illinois for overserving alcohol to the driver. The lawsuit claims the casino’s actions led to a fatal accident on Route 6, just 1.6 miles from the venue. Robert Lee, the passenger, is seeking over $50,000 in damages. The crash involved driver Matthew Sellers, who died from his injuries after the collision. His body was reportedly burned beyond recognition. Lee’s legal team argues that Sellers was heavily intoxicated and unable to drive safely after being served excessive alcohol at the casino.
The lawsuit was filed in Will County Courthouse under Illinois’ Dram Shop Act, which allows victims to hold alcohol vendors accountable for harm caused by drunk patrons. Shuman Legal, a Chicago-based firm, is representing Lee in the case. So far, Penn National Gaming, the casino’s owner, has not publicly responded to the allegations.
This isn’t the first time a casino has faced legal action over alcohol-related crashes. In 2017, the Mohegan Tribe was sued after a patron from Mohegan Sun allegedly caused an accident while drunk. A 2020 incident at the Paris Hotel & Casino parking garage also resulted in a fatality when an SUV crashed into a wall, leading to the driver’s arrest for DUI. Research from 2010 further supports a connection between casinos and higher rates of alcohol-related traffic deaths in surrounding areas. The case highlights the potential risks of overserving alcohol at gambling venues. If successful, the lawsuit could set a precedent for holding casinos responsible under Illinois law. The outcome may also influence how similar establishments monitor alcohol service in the future.
