Khan: "At present, if Netanyahu visited Germany, no action would be taken against him." This is due to the fact that the warrant for arrest is only requested, but not yet approved - and therefore cannot be enforced. Three judges at the ICC in The Hague would need to deliberate on it first. Nonetheless, Khan clarifies, "It might take several months before a judgement is given." Thus, Netanyahu could freely enter Germany for this duration.

What takes place when the arrest warrant is sanctioned?

If the judges grant the arrest warrant, it would create peril for Netanyahu. Khan: "Germany would have to detain Netanyahu as soon as he steps foot in the country." This is due to the obligation of Germany and the 122 other states that are members of the ICC (which includes all EU countries) to arrest a person who has an ICC warrant against them when they cross the border.

What if Germany disregards the arrest warrant?

If Netanyahu manages to enter Germany, Germany might disregard the arrest warrant and let the politician leave. According to Khan, Germany would face no legal repercussions. However, Khan warns, "Germany's international reputation would be harmed significantly, because we are globally perceived as supporters of the ICC and have repeatedly advocated for the court."

Is the arrest warrant destined to be issued?

Khan: "I think that the arrest warrant will be issued in the Netanyahu case." Notably, in previous instances where warrants have been requested, with a single exception, they have been accepted.
