UKGC releases revised license terms for public review.
The United Kingdom's gambling regulatory body, the UK Gambling Commission (UKGC), has revamped its licensing conditions under their "2018-2021 Strategy." The goal is to enhance player protection through clearer requirements. The consultation phase for these changes runs until the 22nd of April, 2018.
The UKGC, following the slogan "Maintain Fair Gambling," has significantly updated its "license conditions and codes of practice" (LCCP), a set of rules crucial to businesses in the UK's gambling industry. This comprises regulations pertaining to businesses' advertising, terms and conditions, and communication with customers. The UKGC initiated this revision due to past infractions by companies that they claim endanger consumer protection and the integrity of the entire gambling sector. These alterations, however, acknowledge that the previous LCCP lacked clarity and specificity, thereby promoting misconduct.
To address this, the UKGC has modified phrasing in some areas, substituting "shall" for "must." Henceforth, businesses must abide by the Advertising Standards Authority's regulations and guarantee that marketing does not mislead. This includes but is not limited to the disclosure of bonus offers' essential elements.
In terms of advertising, all "significant conditions" of a promotion need to be conveyed to the customer when purchasing, if feasible, given space constraints. In the realm of online advertising, the essential tenets of a contract must be easily accessible within a single click.
No Spamming
A novel addition to these regulations is the ban on unsolicited electronic marketing, particularly SMS or email advertising. Firmly adhering to an opt-in procedure is now mandatory: Providers must only contact consumers who have expressly given consent to receiving marketing communications. Each marketing message should also furnish the option to "unsubscribe." This amendment is likely to influence bookmakers as they increasingly utilize personalized notifications to inform clients about their teams' forthcoming matches.
In terms of collaborations with third parties, the LCCP has been adjusted. The new legislation obliges companies to terminate partnerships with affiliate partners promptly if they violate marketing rules. This underscores the UKGC's view that gambling entities are accountable for their affiliates' actions.
Complaints and Penalties
Reforms also stipulate modifications in customer-facing matters. Companies will be required to display their complaints procedures more visibly and make them simpler to access. These businesses must also inform clients of alternative dispute resolution services. In the UK, there's what's known as the Alternative Dispute Resolution scheme - a resource for customers in the event of unresolved conflicts with a provider. Operators are currently inadequate in disclosing this option, often neglecting to clarify that it's free for clients.
Moreover, the LCCP now stipulates a maximum timeframe for handling disputes. The number of weeks allotted for resolution or escalation to higher authorities: eight. This eight-week time limit is customary in many UK industries.
The UKGC's current penalties are deemed sufficient. Beyond revoking licenses temporarily or permanently, there's an ample selection of sanctions at their disposal. The reform doesn't propose an expansion in this region. However, the adjusted language should make it simpler for the UKGC to justify imposing fines. The industry has up to the 22nd of April, 2018, to provide input on these changes. The anticipated implementation date should also be declared then.
