German Federal High Court verdict - The person responsible for causing a fatal accident is set to appear in court once more.
On April 6, 2021,the Ingolstadt Regional Court passed judgment on driver Ali K. (25), who was given a sentence of three years and six months in prison for various offences, including illegal car racing that resulted in a death.
According to the Regional Court's findings, on October 20, 2019, K., who was 22 at the time, was driving his 575 hp BMW M4 along the A9 near Ingolstadt at speeds exceeding 200 kilometers per hour.
Suddenly, an Audi A4 attempted to switch lanes at 120 km/h, prompting a collision between the two vehicles. The driver of the BMW died as a result.
Since the BMW had been illegally tuned and was no longer street legal, K. was tried in court. However, the defendant and the victim's family appealed for a manslaughter conviction.
â–ºThe appeals were granted, leading to the case being retried. Consequently, K. was sentenced again--this time, to three years and four months.
A second appeal was submitted, prompting the high court in Karlsruhe to reverse the previous judgment once more due to incorrect fact-finding procedures in the initial trial. As a result, the case had to be heard in court for the third time.
Controversy over court location
Dr. Adam Ahmed, Ali K.'s lawyer, expressed dissatisfaction with the location of the upcoming trial: "I believe it's problematic that this third trial is happening in Ingolstadt once again. To provide complete impartiality, it would've been preferable to hold the retrial at a different court."
The exact date for the commencement of the trial at the Ingolstadt district court for a third time is yet to be announced.
