Handball Club Takes Legal Action

Yesterday afternoon, a judge decided to give HSV Hamburg a license, but only on the condition that they deposit a huge sum of money by the coming Wednesday.

A few hours later on Friday morning, independent of the court's verdict on the arbitration proceedings, Jörg Föste, the managing director of Bergischer HC, released a statement on their website. What stood out in the first sentence was that it referred to a period even before this current season.

"To the Bergischer HC, the arbitration court's decision doesn't make any sense. Financial advisers from HSV Hamburg have stated since December 2022 that HSV Hamburg doesn't meet the requirements for participation in the HBL. The HBL finally agreed with this assessment in their decision back in April 2024."

Then the BHC tackled the arbitration court proceedings: "The arbitration court has now confirmed that HSV Hamburg had a shortfall of about EUR 4.1 million during the crucial licensing period. The ruling goes further than the HBL's initial decision by requesting additional financial security."

More allegations are hurled: "For over a year, HSV Hamburg has been violating the financial regulations set by the HBL. They shouldn't have been given a license for the current season, and ideally, they should have had it revoked much sooner. According to HBL regulations, they would have been ineligible for a new license if the conditions beneath the HBL's licensing decision had been deemed flawed—without such flaws having any effect."

The club's bombshell revelation: "In the eyes of the BHC, the license granted to HSV Hamburg by the arbitration court for the upcoming season seems irregular."

Their justification: "The court's judgement is contrary to the aims of licensing, which is to build stable and credible management and financial frameworks. The arbitration process, in which license exclusion deadlines and financial criteria are decided at will, provides no foundation for a fair and cohesive competition."

Finally, the BHC shared their plans for future challenges: "Before the arbitration court's decision and even in the BHC's own arbitration proceedings, we brought these issues and our legal perspective to the HBL's attention. We are determined to carry on this route to uphold our rights."
