The Austrian public prosecutor's defense attorney will not bring forward any exculpatory arguments during the upcoming trial, according to the "Tiroler Tageszeitung." This information was disclosed by the attorney, Heiss, who is also working with his colleague Mathias Kapferer (59).
They are currently discussing the trial's proceedings with the presiding judge. Heiss's wife, Sandra, is expected to testify in court against the prosecutors' claim that Florian A. deliberated killed their child, Leon, on August 28, 2022, out of compassion and overwhelmed by the child's syngap disease.
Heiss confidently asserts that his husband never killed their child. At the time of Leon's death, the couple had made improvements to their home for the disabled child and had hired two additional caregivers starting in September.
Prosecution: Faux Robbery with Pink Hugo Bottle
The public prosecutor's office alleges that the fitness trainer faked a robbery to divert suspicion from himself to a stranger. To accomplish this, they assert that he smashed a bottle of "Pink Hugo" on his head after the murder.
60 witness statements and several expert reports will supposedly prove Florian A.'s guilt. These include an analysis of his online activity prior to the incident, which allegedly shows that he researched "fainted" before simulating his fainting.
However, the defense team has written a 53-page rebuttal, and they plan to summon four expert witnesses to the trial at the Innsbruck Regional Court. These experts will focus on analyzing Florian A.'s cell phone use, the broken "Pink Hugo" bottle, and his internet behavior at the time of the crime.
Lawyer Heiss expressed his confidence in the impartial nature of the trial, stating that the independent jury, in collaboration with the professional judges' senate, would determine his client's innocence based on the defense's perspective.
