The Dutch gambling regulatory body issues warnings to YouTube personalities: promoting unauthorized gambling platforms will result in penalties.
The Dutch Gaming Authority (KSA) instructs two YouTubers to take down promotional videos for unauthorized gambling sites. The regulatory body also advises other influencers and web platform administrators to comply with regulations.
Influencers erase video post only following secondary warning
In a public announcement [Dutch site], the KSA announced that it requested two social media personalities to delete a YouTube video that advertised an unlawful gambling platform in the Netherlands.
At first, the influencers merely pixelated the displayed site but still referred to the provider in the audio commentary. It wasn't until receiving a second warning from the KSA that the influencers eventually eliminated the video from the platform altogether.
Illicit advertising endangers susceptible individuals
The charges against the two YouTubers are severe, asserting that the video exposed vulnerable individuals to potential harm since the illicit provider would disregard protective measures for players.
Individuals listed in the CRUKS registry - equivalent to the German OASIS registry - have access to prohibited sites, despite being banned from gambling.
KSA and GGL adopt similar tactics
The KSA's targeting of influencers for combating illicit gambling seems to be a strategy other authorities, such as the German Gaming Authority of the Länder (GGL), are also adopting.
The GGL recently garnered court approval to implement sanctions against foreign streamers targeting a German-speaking audience.
Similarly, a high-profile incident surrounding YouTuber Ron Bielecki surfaced last year, resulting in a 480,000 euro fine for operating an unlicensed gambling service and advertising unauthorized providers.
KSA plans to enact harsher penalties in the near future
In the aforementioned case, the two YouTubers appear to have avoided fines or other punishments. However, the KSA aims to adopt a more stringent stance in the future and no longer tolerate inexcusable ignorance from online content creators.
The KSA often encounters feedback indicating that publishers were unaware of the unlicensed status of the websites they promoted. Such ignorance will no longer be considered a valid excuse in the future.
In the official KSA statement, the regulatory body stresses that advertisers hold responsibility for verifying whether a gambling company that seeks advertising qualifies for a license. If an advertiser promotes an unauthorized offer, they risk facing sanctions. – KSA statement, source: KSA
