MGM Resorts International Faces Lawsuit Over Finding Bat in Strip Hotel, Amounting to $15,000

In 2022, a group of eight individuals from Arizona experienced a harrowing incident during their stay at the New York-New York hotel in Las Vegas. They claim they were forced to undergo preventative rabies treatments after sharing their hotel room with a live bat. In a recently filed civil complaint against MGM Resorts International, the company that operates the casino resort, the plaintiffs argue that the hotel failed in its duty to ensure the safety of its guests.

The lawsuit, filed in the Clark County District Court on August 10, alleges premise negligence and is seeking $15,000 in damages. According to the complaint, the bat was not discovered until after the room's occupants, which consisted of three families with a total of four adults and four children, had fallen asleep. This allowed the bat to potentially come into contact with all of them.

Marcus Rucker, one of the hotel guests, claims he was woken up in the early hours of April 11 by a noise in the curtains. Rucker allegedly killed the intruder with a shoe, before placing it in a cup and hiding it in a nearby stairwell. He later reported the incident to a front desk employee, as per the lawsuit.

Upon returning home, the plaintiffs contacted their local health department, who advised them to test the bat for rabies or else everyone who had been in the room would need to undergo rabies exposure treatment.

Rabies is a deadly disease, with no effective treatment once symptoms occur. The Centers for Disease Control and Prevention report that it causes around 59,000 deaths worldwide and two in the US every year. Bats are responsible for most of the rabies deaths in the United States.

Bat Disposed of Improperly

When the plaintiffs contacted the hotel's front desk, they were informed by a manager that the bat had been disposed of without being tested. Consequently, the plaintiffs were forced to undergo a series of painful injections to prevent contracting rabies.

The plaintiffs maintain that the hotel operators should have taken steps to prevent their exposure to pests and diseases and should have known to preserve the bat for rabies testing.

In a similar case in 2017, a guest at the Jenny Lake Lodge in Moose, Wyoming, was bitten by a bat. When the company failed to foot the guest's medical expenses, a lawsuit was filed, which was eventually settled by Jenny Lake Lodge, Grand Teton Lodge Company, and Vail Resorts in 2021.
