Bavarian plan discussed in meeting of justice ministers' gathering - Individuals advocating for the return of a caliphate should face consequences.

Georg Eisenreich, the Justice Minister of Bavaria (53, CSU), urges that those who encourage disrespect towards liberal-democratic foundations should face legal consequences. In other words, anyone advocating for the caliphate in Germany must be penalized.

Eisenreich additionally states that suggesting the caliphate for Germany is a challenge against our legal system. This is utterly unacceptable as terrorist groups like the "Islamic State" proclaimed the caliphate in 2014.

Freedom of opinion and assembly are highly valued principles. However, we cannot allow the spread of Islamic State propaganda for a state inimical to humanity.

The Justice Ministers' Conference will convene on June 5 in Hanover. As it stands, advocating for a caliphate is not a punishable offense in Germany. Thus, the Federal Justice Minister is being asked to propose a criminal regulation and exploit the available constitutional flexibility.

Public advocacy for establishing the caliphate or introducing Sharia law sows division, offers a fertile ground for hatred, intolerance, and anti-Semitism. The motion drafted for the Justice Ministers' Conference is part of Bavaria's legal measures against extremism and anti-Semitism.

Previously, in November 2023, Bavaria proposed a bill in the German Parliament to criminalize "sympathizing with terrorist organizations." This measure was in response to the Hamas demonstrations following the terrorist assault on Israel on October 7, 2023.

Bavaria's Justice Minister remarked, "Our proposal is waiting for the federal government's action and closure of this protection void."
