Educational Institutions - Illicit drug use continues to be strictly forbidden in educational institutions.

Despite the partial legalization of marijuana, its use in schools is still strictly prohibited for both students and teachers in North Rhine-Westphalia. The Ministry of Education asserts that schools can include a ban on marijuana in their rules for health reasons.

Education Minister Dorothee Feller expressed her stance when speaking with the German Press Agency, stating that "cannabis has no place in our schools." Unfortunately, the federal government hasn't yet established a clear legal foundation for banning marijuana in schools. Therefore, it's crucial that they follow through with their pledge and promptly enact preventive measures for kids and teenagers. "We will continually evaluate if additional steps are necessary to safeguard children and youth," she added.

This previous week, an explanation from the Hessian Ministry of Education garnered attention, stating that students of legal age are permitted to bring as much as 25 grams of marijuana to school in their bags or backpacks without facing any repercussions. Nonetheless, consuming marijuana at school or within a 100-meter radius of it remains forbidden, as the Wiesbaden Ministry of Education revealed. In fact, some schools or school administrators have adopted their own rules to prohibit bringing drugs onto school premises or owned property.

The NRW Ministry of Education highlighted that minors are barred from possessing marijuana not just at school, but also off school grounds. In the event a teacher discovers marijuana on a student, it should be temporarily taken away and later returned to the student's parents. "However, searching pupils or the items they possess is not allowed," the ministry stressed.

In essence, adult students can carry the permitted amounts of marijuana into school premises if there isn't an express ban in the house rules. The ministry also offers online resources and materials about cannabis prevention that can be used in lessons.

A new national cannabis law took effect on April 1st. Since then, adults are permitted to possess and consume marijuana under certain conditions in Germany. However, it remains illegal for minors and in public areas, including schools and youth facilities.
