Yakutia's leader has issued a decree to prohibit foreigners from working under patent agreements
In a move aimed at protecting the national labor market, the Head of the Republic of Yakutia, Aisen Nikolaev, has signed a decree banning the attraction of migrant workers for the development of construction projects and demolition and dismantling of buildings, effective from February 28, 2024.
The decree, No. 220, specifically targets employers operating in the fields listed in the decree, who are prohibited from hiring foreign citizens working on the basis of patents. This ban is one of the main mechanisms for protecting the national labor market, allowing for a balance of interests between employers and Russian workers.
The All-Russian Classifier of Economic Activities has specific groups for the development of construction projects (41.10) and demolition and dismantling of buildings (43.11). Employers or contractors in the construction sector are obliged to notify the territorial body of the federal executive authority in the sphere of internal affairs about the termination (dissolution) of the employment (civil-law) contract for the performance of works (provision of services) within a period not exceeding 3 working days from the date of termination (dissolution) of the corresponding contract. Non-compliance with this requirement is punishable by administrative liability.
Violation of the restrictions on foreign citizens and stateless persons by employers or contractors will result in administrative liability. However, the ban does not apply to foreign citizens temporarily or permanently residing in the republic, citizens from Eurasian Economic Union countries, or citizens from countries with a visa requirement. A transition period of 3 months is provided for to complete employment relationships with foreign citizens employed in these areas.
