New Jersey Poised to Ban Sweepstakes Casinos
In a significant development for the iGaming industry, Assembly Bill 5447 (AB 5447) is currently awaiting Governor Phil Murphy's signature or veto. If signed into law, the bill will effectively ban sweepstakes casinos in New Jersey, making it the sixth state to enact such a law.
The bill, which passed both the Assembly (69-10) and Senate (34-5), has strong legislative support. Upon becoming law, it will make it illegal to operate online sweepstakes casinos in New Jersey immediately, either the day it is signed or automatically after the 45-day window if the governor does not act (pocket approval).
In anticipation, several sweepstakes casinos, such as Funzpoints, Spree, Club Casino, Clubs Poker, and LuckySlots.us, have already exited or are in the process of exiting the New Jersey market to avoid violating the law.
The bill also includes broader provisions related to sports betting, such as criminalizing rigging outcomes and proxy betting. These provisions may impact New Jerseyβs regulated sports betting liquidity and taxation strategies.
The Social and Promotional Games Association (SPGA), representing sweepstakes operators, opposes the bill, criticizing it as influenced by entrenched casino interests. They have urged Governor Murphy to veto the bill.
As of late July 2025, Governor Murphy has not yet signed or vetoed the bill, but the timeline for enforcement and exit of sweepstakes operators is imminent.
