Masimo and Apple's Patent Dispute: A Mixed Verdict

In a recent development, a federal jury has delivered a mixed verdict in the patent infringement lawsuit between Masimo Corporation and Apple Inc.

Apple had filed a lawsuit against Masimo, alleging that the design and functions of Masimo's new smartwatch series, the W1, closely resemble those of the Apple Watch. The jury agreed with Apple, awarding them $250 in damages. However, the jury did not grant an injunction against Masimo's current products.

Masimo, on the other hand, considers the lawsuit a win, as they were not granted an injunction against their current products. This means that Masimo's W1 smartwatches will continue to be sold.

The jury also found Masimo guilty of infringing on one patent related to the Apple Watch's puck-shaped charger's original design and charger. Apple thanked the jury for their careful consideration in the case.

Apple's attorney stated that the company is not after the money, but wants Masimo to stop copying its design. Masimo, in its defence, has maintained that it takes great care to ensure its products are original and innovative.

In a separate development, the International Trade Commission (ITC) granted an import ban on Apple's Apple Watch Series 9 and Ultra 2, forcing Apple to remove its blood oxygen feature from those watches and the Series 10. This ban was due to a patent lawsuit filed by Masimo in 2020 over the Cupertino company's blood oxygen sensor in its smartwatches.

The case for the ITC's import ban appeal is currently making its way through the federal circuit for the U.S. Court of Appeals. Apple is still proceeding with an appeal for the ITC's import ban on Apple Watch Series 9, Ultra 2, and Series 10.

Both tech giants have reiterated their commitment to protecting their intellectual property and advancing innovations on behalf of their customers. The ongoing dispute between Masimo and Apple serves as a reminder of the importance of patent protection in the fast-paced world of technology.
