Railway company faced with compensation claim of 283,000 due to provision of un-airconditioned carriage to passengers
A family from the Khanty-Mansi Autonomous Okrug has successfully won a lawsuit against the Federal Passenger Company, a subsidiary of RZD, after enduring intolerable train conditions during their journey from Yekaterinburg to Adler last summer.
The family, named Kulikov, paid 51,000 rubles for tickets, expecting a comfortable journey. However, they encountered a stuffy, dirty carriage with a temperature of 37°C due to non-functioning air conditioning. The ventilation did not work, and windows could not be opened, forcing passengers, including the Kulikov family, to seek refuge in the corridor near open windows.
Toilets in the carriage were blocked during the journey, and for hot water and toilet use, passengers had to go to the neighboring carriage. The situation became even more challenging when a child in the family fell ill, requiring medics to be called.
Despite their complaints to the Federal Passenger Company, they received a refusal for compensation. Undeterred, the family took the matter to court. Last summer, the Sovietsky District Court of KhMAO partially satisfied the claim, ordering FPC to pay 283,000 rubles to the Kulikov family.
The family's journey was far from comfortable, but their perseverance has ensured that others may not have to endure similar conditions in the future. This serves as a reminder for railway companies to prioritise passenger comfort and safety.
