Overburdened German Criminal Courts According to Recent Report
In 2024, Germany's criminal courts faced a severe overload as the number of new cases continued to rise, according to a report by the German Judges' Association. The association revealed that around 5.5 million new cases were received, marking a 515,000 increase from 2020. This marks the second consecutive year of such high numbers, and the backlog of unresolved cases has been growing since 2020.
The increase in case numbers has led to a significant decrease in the number of trials. In 2024, only one in 16 cases led to a trial, compared to one in ten in 2014. The number of cases being dropped by prosecutors has also been increasing since 2020. By the end of 2024, there were 950,000 unresolved cases pending with the prosecutors, approximately 240,000 more than in 2020.
The personnel shortage in German courts and public prosecutor's offices is primarily caused by retirements and a lack of sufficient new hires nationwide. Some regions, like Mecklenburg-Vorpommern, have been successful in recruiting many new judges and prosecutors. However, other states, such as North Rhine-Westphalia, face severe understaffing and high workload pressures.
The federal government has announced strengthening measures to address these issues. These measures include increasing staffing in relevant judicial offices, enhancing the protection and respect for legal professionals, and restoring trust in institutions. Additionally, more consistent prevention and prosecution efforts are being planned. Specific nationwide recruitment programs and legislative measures to remedy shortages are still in development.
The Bild newspaper reported this information based on an analysis by the Judges' Association. The situation underscores the need for urgent action to address the backlog of cases and ensure that justice is served efficiently and effectively in Germany.
