Ongoing Dispute in Pope County as Casino License Loser Files Lawsuit Against State

The Pope County casino project, which promises an estimated $5 billion in economic activity over its first decade, has taken a new turn as Cherokee Nation Entertainment (CNE) has filed a lawsuit against the state of Arkansas.

The legal action, centred around the constitutional amendment named Issue 2, seeks to challenge the approval and implementation of the amendment, which allowed the Pope County casino development. CNE argues that the amendment has negatively impacted their rights and interests, and they aim either to have their casino license reinstated or to obtain compensation for the losses resulting from the state's actions permitted by the amendment.

The lawsuit, filed in a federal court, calls upon a judge to rule the constitutional amendment unconstitutional. The amendment, which passed overwhelmingly, was approved despite voters in Pope County wanting the development of the casino to proceed.

The Pope County casino project has a complex history. In June, the Arkansas Racing Commission awarded the license for the project to CNE. However, Arkansas residents effectively voted to strip CNE of the license it received, leading to the current lawsuit.

The project, if successful, could significantly boost the regional economy. The lawsuit marks the latest chapter in a long-standing dispute between CNE and the state of Arkansas over the legitimacy and consequences of Issue 2, and its impact on CNE's ability to operate the casino project they had planned in Pope County.

Despite the legal dispute surrounding the Pope County casino project, there has been growing interest in alternative forms of gambling, such as online casino-games, sports-betting, and lotteries, which are becoming popular gambling-trends. This shift in consumer preference raises questions about the future of traditional casino-gambling establishments like the one envisioned in the Pope County project.
