In the rapidly evolving world of media, generative AI tools are gaining traction as they are increasingly used to produce various forms of content, such as video, sound, text, and images, in creative workflows. One of the major players in the industry, Netflix, has emphasized the importance of adhering to certain guidelines when leveraging these tools.

The guidelines, designed to protect personal data, creative rights, and prevent copyright violations, ask partners to consider several guiding principles before using Generative AI. These principles include ensuring that outputs do not infringe on copyrighted material, avoiding storing, reusing, or training on production data inputs or outputs, and obtaining written permission from Netflix for any intended use of the technology.

Netflix places a strong emphasis on protecting personal data and creative rights. The streaming giant expects all production partners to share any intended use of Generative AI with their Netflix contact, especially as new tools continue to emerge. Partners are also cautioned to be mindful when making changes that could affect a performance’s emotional tone, delivery, or intent, as even subtle edits may have legal or reputational implications.

The guidelines provide a practical tool for assessing and enabling confident GenAI use when producing content for Netflix. They stress that if a partner answers "no" or "unsure" to any of these principles, escalation and written approval may be required.

Some situations that always require escalation and written approval include using Generative AI to generate main characters, key visual elements, or fictional settings that are central to the story, using Netflix-owned materials or personal data (e.g., cast or crew details) in Generative AI tools, and creating digital performers, voices, or likenesses of real talent without explicit and documented consent.

Netflix also advises partners to avoid using inputs that reference copyrighted materials or likenesses of public figures or deceased individuals without appropriate permissions. Furthermore, the use of Generative AI should not replace or materially impact work typically done by union-represented individuals without proper approvals or agreements.

The guidelines also caution against creating content that could be mistaken for real events, people, or statements if they never actually occurred. In addition, the use of Generative AI must be done with care, especially when it forms a visible or story-critical part of the production.

Netflix sees these tools as valuable creative aids when used transparently and responsibly. The guidelines apply not only to Netflix's internal operations but also to partner vendors and subcontractors in post-production. The streaming giant has released detailed guidelines for the use of generative AI in media operations and production, aiming to ensure compliance with its clear guidelines on AI usage.
