Investigation: Unlawful Search involving a Youthful SPD Politician

In the Sauerland region, the home of SPD youth politician Nela Kruschinski was illegally searched on April 1, 2025, without her presence or a formal arrest warrant request. The search authorisation was issued by the Arnsberg District Court based on insufficient evidence and an application by the police rather than the prosecution.

The search, which took place during Kruschinski's preparations for her final exams, led to the seizure of her laptop, phone, and several notebooks. The incident was reportedly due to graffiti against the federal chancellor, Armin Laschet (CDU), during a campaign appearance. The graffiti included slogans such as "Punch Merz" and "Antifa on the offensive".

However, Charlotte Merz, who is the chairwoman of the Arnsberg District Court and the wife of Armin Laschet, has reportedly denied having any influence or knowledge of the search warrant. The document was signed by a judge on probation. The investigating judge at the regional court reportedly admitted to not having contacted the public prosecutor's office.

Thomas Kutschaty, a lawyer and SPD state parliamentarian, filed a complaint against the search warrant on behalf of Nela Kruschinski and won. The Arnsberg regional court later ruled the search warrant to be illegal.

It is important to note that there have been massive fake news campaigns targeting Armin Laschet (CDU) and Charlotte Merz. Another piece of evidence used to justify the search warrant was a "vague" statement of a witness who saw "two younger persons" near a shooting range but did not recognize them.

There has been no mention of Jusos, Friedrich Merz, the Federal Election 2025, or hate comments in relation to this incident. The application for a house search by the public prosecutor's office was not found in the files. An anonymous tip to the police in Hagen, calling for Kruschinski and a friend of the Juso local chairwoman to be "put under surveillance," was also reported.

This incident has sparked controversy and raised questions about the legality of the search and the potential influence of political figures in such matters. The SPD and the CDU have yet to make official statements regarding the matter.
