Individuals in Berlin Found Guilty of Unlawful Possession of 200-kilogram Fireworks
In a recent court case, a 35-year-old truck driver was sentenced to six months in prison, suspended, for violating the Explosives Act and the Weapons Act. The defendant, who is a father of two and previously unblemished in his professional life, was found guilty of possessing illegal fireworks in an apartment in Berlin-Spandau.
The Berlin police seized approximately 200 kg of illegal fireworks from the apartment, just before New Year's Eve. The illegal fireworks included 14 shell bombs and 800 large firework bombs, which were among the seized items. Shell bombs, as it turns out, are special firework bodies with high explosive power that are not allowed for general use in Germany.
The defendant had not obtained a license before buying the pyrotechnics, which he purchased for around 500 euros in the Czech Republic. His lawyer admitted that the client had tried to obtain a fireworks license, but there is no information in the provided search results about anyone attempting to obtain a pyrotechnician license in Berlin or when such an attempt took place.
The defendant, who expressed regret for his actions, also faced charges for having a stun gun, for which he did not have the required weapons permit. The illegal fireworks were found in the dining room and hallway of the apartment.
The trial took place in the Tiergarten District Court. The public prosecutor demanded a sentence of seven months on probation, while the defense attorney pleaded for a lenient sentence but did not make a specific request.
The seizure of the fireworks occurred amidst a series of serious incidents involving explosive bodies like shell bombs in Berlin during New Year's Eve 2024/25. Several serious incidents, including boats catching fire during the Panorama Festival, possibly due to a fireworks malfunction, highlighted the dangers of illegal fireworks.
The defendant's aim, according to his lawyer, is to obtain a fireworks license. Whether he will be granted one remains to be seen, but for now, he will have to serve his suspended sentence as a reminder of the seriousness of his actions.
