Federal court overturns most Trump-implemented tariffs, deeming them unlawful under federal statutes

In a significant development, the US Court of Appeals for the Federal Circuit has declared that many of President Donald Trump's international tariffs were illegal. The ruling, which affirms a lower court's finding, could potentially cast doubt over deals struck with major trading partners such as the European Union.

The tariffs in question were imposed on Mexico, Canada, and China, ostensibly over the flow of deadly drugs into the United States. However, the ruling noted that the International Emergency Economic Powers Act (IEEPA) does not explicitly authorize the President to impose tariffs, duties, or the like.

The ruling does not address if Trump's actions should have been taken as a matter of policy or decide whether IEEPA authorizes any tariffs at all. Instead, it seeks to resolve the question of whether Trump's "reciprocal" tariffs and those imposed over trafficking were authorized.

The tariffs, which have been a wide-ranging economic policy tool wielded by President Trump, are allowed to remain in place for now, through mid-October. The appeals court had previously put the ruling on hold to consider the case, but Friday's ruling affirmed the lower court's finding.

Treasury Secretary Scott Bessent warned that suspending the effectiveness of tariffs would lead to dangerous diplomatic embarrassment. Commerce Secretary Howard Lutnick stated that such a ruling would threaten broader US strategic interests at home and abroad, likely lead to retaliation and the unwinding of agreed-upon deals by foreign-trading partners.

President Trump has expressed his displeasure with the ruling on his Truth Social platform, stating that he will put the time to use to fight the ruling. Several legal challenges have been filed against the tariffs Trump invoked by citing a national emergency. If these tariffs are ultimately ruled illegal, companies could possibly seek reimbursement.

The question of what would happen to the billions of dollars collected by the United States since the tariffs were put in place if the conservative-majority Supreme Court does not back Trump remains open. Lutnick also added that these actions could derail critical ongoing negotiations with partners.

The ruling marks a blow to President Trump, who has been known for his aggressive use of tariffs in his economic policies. The decision could have far-reaching implications for US foreign policy and national security, as well as the country's economic relations with its trading partners.
