Kamchatka Court Grants Young Diabetic Man Essential Medical Support
A young man in Kamchatka, who was diagnosed with insulin-dependent type 1 diabetes at the age of 11, has received a significant victory in his fight for essential medical support. The Kamchatka Regional Court has ruled in his favour, ensuring he continues to receive the necessary medical devices for his condition.
The young man's health problems began in 2016, and he was given the status of a child-invalide, entitled to regular treatment. After being fitted with an insulin pump in 2019, he had the device regularly replaced and was provided with necessary consumables. However, when he turned 18 and lost his child-invalide status, the supplies of insulin pump consumables stopped.
The young man appealed to the Kamchatka Regional Court after being denied further free supplies by the hospital and the regional health ministry. The first instance court refused to satisfy his claim due to the loss of his child-invalide status after turning 18.
However, the appellate instance noted that the loss of child-invalide status and the absence of adult invalidity cannot deprive a citizen of the right to necessary medical support. The court's decision was based on the fact that the insulin pump was installed as part of a high-tech medical aid program. The court also stated that the insulin pump was installed for life-saving reasons.
The court did not specify the respondents in its decision, but a court bailiff executed the decision and provided the young man with the necessary medical devices. The court's decision was made by the joint press service of the regional courts, as reported by IA "Kamchatka".
