Dutch regulator cracks down on illegal gambling and weak player protections

Dutch regulator cracks down on illegal gambling and weak player protections

The Dutch Gaming Authority (Kansspelautoriteit, KSA) has cracked down on illegal gambling and weak player protections. Two major enforcement actions were announced this week. One targets unlicensed operators, while the other forces bet365 to tighten its social responsibility rules.

The KSA ordered prediction market platform Polymarket to stop offering services in the Netherlands. The regulator classified its operations as illegal gambling under the 2021 Remote Gambling Act. Polymarket now faces weekly fines of €420,000, with a maximum penalty of €840,000 if it fails to comply.

In a separate case, the KSA imposed record fines on two unlicensed operators. Novatech was fined €24.846 million, while Fortaprime received a €1.795 million penalty. Both companies had targeted Dutch players without the required permits.

Meanwhile, bet365's parent company, Hillside, was ordered to improve its duty of care measures. A KSA investigation found that the operator's affordability checks were inadequate. Players who could not afford their wagers were not properly blocked. The regulator gave bet365 four weeks to fix its assessment processes and set correct deposit limits.

Failure to meet these demands could lead to further sanctions. The KSA warned that bet365's gambling permit might even be revoked if it does not comply.

The KSA's actions signal stricter enforcement of Dutch gambling laws. Unlicensed operators now face heavier fines, and licensed firms must ensure stronger player protections. Bet365 has until the deadline to implement the required changes or risk losing its permit.
