DraftKings Faces Regulatory Scrutiny in Multiple States

In a series of regulatory developments, sports betting giant DraftKings is facing penalties and reviews in several U.S. states due to compliance issues.

Massachusetts Takes Action

The Massachusetts Gaming Commission (MGC) has fined DraftKings $450,000 for permitting 1,160 unlawful wagers totaling over $83,000, placed via credit cards between March 2023 and February 2024. The commission deemed these violations as serious compliance failures and mandated refunds to affected customers, a third-party audit, and proof of corrective measures [1][2][3][4][5].

This is not the first time DraftKings has faced regulatory issues in Massachusetts. The company has been fined $150,000 for allowing proxy betting, as reported by the commission [6].

Regulations Across the Nation

Similar credit card deposit bans exist in other states such as Iowa and Tennessee, with Illinois considering stricter restrictions as well [2]. These regulations aim to prevent easy credit-based betting due to concerns about responsible gambling and financial risk management.

In Ohio, the Casino Control Commission has flagged DraftKings and two other operators for failures related to responsible gaming messaging and the use of the term "risk-free" for bets. Each operator could be subject to a $150,000 fine in Ohio [7].

Ongoing Legal Challenges

DraftKings recently won a key court ruling in New York, dismissing a class-action lawsuit challenging its promotional bonus practices. This victory may aid its defense against similar suits elsewhere [2]. However, the company is still facing ongoing scrutiny and lawsuits in various states.

MGC Reviews and Applications

The MGC has announced it will launch retail sportsbooks on January 31 and aims for early March for digital platforms. The commission has reviewed applications from Bally's, FanDuel, Betr, DraftKings, Digital Gaming, and PointsBet. The review of Fanatics' application is ongoing, with the commission continuing its review in executive session, and the review will continue at 8 a.m. Thursday [8].

DraftKings has acknowledged violations around direct mail, licensing paperwork, and some reporting issues [9]. The company has also been questioned about the "free bet" language used in some of its advertising and marketing by Commission Eileen O'Brien [10].

Expanding Market, Increased Scrutiny

These developments reflect heightened regulatory enforcement around responsible deposit methods and marketing in the expanding U.S. sports betting market. As the industry grows, so does the need for strict compliance with state regulations to ensure fair and responsible gaming practices.
