Delay accountability aimed at contractors affiliated with DPWH in relation to postponements in Cebu flood management undertakings.
In a bid to ensure timely completion and minimise disruptions caused by prolonged construction, Cebu City Mayor Nestor Archival is pushing for accountability of Department of Public Works and Highways (DPWH) contractors in flood control projects.
The mayor has directed the Cebu City Legal Office to study a proposed move that would require contractors to submit undertakings before permits are granted by the Cebu City Transportation Office (CCTO) for digging purposes. These undertakings commit contractors to cover liquidated damages for project delays.
The accountability measure is intended to cover ongoing and upcoming projects in 2025. The CCTO issues excavation and related permits, a fact mentioned earlier. While the City has no direct authority over DPWH contractors, it can enforce the requirement through the CCTO, as stated by Mayor Archival.
The liquidated damages penalties for delays do not go to the City, but to the DPWH, as previously mentioned. Mayor Archival has not specified any changes to the penalties for delays going to the DPWH in the current discussion.
The mayor is also pushing for the accountability of DPWH contractors in flood control projects. The responsible authority office in Cebu City that issues permits for excavations and related projects and requires construction companies to provide assurance for liquidated damages in case of delays is the City Engineering Office.
