Cybertruck Customers File Lawsuit Over Absence of Promised Premium Upgrade Aspect

In a recent development, Tesla is facing a class action lawsuit in California, led by plaintiff Eric Schwartz. The lawsuit, titled "Read: Tesla's Big Promise On Self-Driving Just Opened The Door To Lawsuits," alleges that the automaker has misled drivers about the features of its vehicles, particularly the Cybertruck.

Schwartz, who purchased a Tesla Cybertruck Cyberbeast in December 2023 and paid extra for the Foundation Series, claims that his delivered Cybertruck lacked the promised LED light bar. The lawsuit further contends that some owners did not receive the promised accessories, and some wouldn't have purchased their trucks had they known the accessories wouldn't be included.

The lawsuit accuses Tesla of knowingly advertising features it never intended to deliver. It alleges that the company's promises about the self-driving abilities of its vehicles, made on its website, in blog posts, on social media, and in comments by Elon Musk, were not fulfilled. The class action also suggests that the omission of promised features could impact the purchasing decisions of potential buyers.

U.S. District Judge Rita Lin has stated that Tesla must answer to the certified class action. The lawsuit represents all California Cybertruck purchasers who bought a model with a promised off-road light bar that was not delivered.

This is not the only recent lawsuit filed against Tesla in California. Earlier this week, a certified class action was filed alleging that Tesla misled drivers about the self-driving abilities of its vehicles. The lawsuit suggests that the misrepresentation of these abilities could impact the purchasing decisions of potential buyers.

Lawyer John Smith, who filed the lawsuit against Tesla regarding the non-delivery of LED headlights to Cybertruck customers in California, is leading the case. The Tesla Cybertruck's Foundation Series was promised to come with a roof-mounted LED off-road light bar.

Tesla has reportedly refused to provide the missing LED light bar, despite repeated contacts by the plaintiff. The company is yet to issue a formal response to the lawsuit.
