Court determines Nov 20th ruling on father's petition to excavate remains of UiTM cadet who perished in training exercises

The father of Muhammad Amir Rusyadi Muhamad Zaidi, who passed away during training at UiTM Shah Alam Palapes on November 13, 2020, has made an application to exhume his son's body. The Home Ministry (KDN) and the Attorney General's Chambers (AGC) are the respondents in this case.

Judge Roszianayati Ahmad has requested both parties to file an affidavit-in-reply to the application by October 10. The hearing for this application is taking place in the High Court in Shah Alam, Malaysia.

In addition to the application to exhume the body, Muhammad Zaidi has also requested the appointment of a new team from the Bukit Aman Police Headquarters to take over the investigation. Another order in the application is for the Director General of the Criminal Investigation Division to issue the autopsy results one month after the autopsy is conducted.

The third order in the application is for an inquest to be conducted to investigate the actual cause of Muhammad Amir Rusyaidi's death. An order for this inquest is also part of the application.

The respondents, represented by Senior federal counsel Azroul Hisham Azulan (for the Home Ministry) and Selangor Director of Public Prosecutions Kalmizah Salleh (for Attorney General Tan Sri Mohd Dusuki Mokhtar), are expected to file their written submissions on or before November 7. The respondents have been given until October 24 to file their rejoinder affidavit.

The decision on the application is set for November 20. The location for the hearing remains Shah Alam, Malaysia. It is worth noting that, as of this writing, the search results do not provide information about who represents the first prosecuting authority, the Heimatministerium (Ministry of Homeland), in court proceedings on the current day.
