The Hamburg Constitutional Court has announced its ruling in a dispute between the Alternative for Germany (AfD) and Senator Andy Grote. The complaint, which was based on an alleged breach of neutrality, stemmed from a statement made by Senator Grote during a parliamentary session in November 2023.

The dispute, which also involves the Senate, centres around the AfD's perceived infringement of rights due to Senator Grote's statement. The AfD contends that the accusations made by Senator Grote are baseless and that their rights have been infringed upon.

Senator Grote's statement claimed that the AfD had become radicalized and that the party relativizes National Socialism and the Holocaust. The Senate, represented by the Social Democratic Party (SPD), argues that this statement was a reaction to previous statements made by individual AfD members during the same debate.

However, the Constitutional Court dismissed the AfD's organ complaint against Senator Grote, ruling that Grote is allowed to express political criticism of the AfD in parliamentary debates. The court stated that the neutrality requirement does not apply there. This decision was publicly announced on September 5, 2025.

During an oral hearing in early July, the Constitutional Court had not yet indicated any inclination regarding the dispute. The Senate considers part of the AfD's complaint to be invalid, while the AfD argues that Senator Grote intervened in the political process in an impermissible manner.

The AfD's complaint is focused on both Senator Grote and the Senate, alleging that they breached neutrality and improperly intervened in the political process. The AfD feels that their rights have been infringed upon by this statement and the Senate's response.

Despite the ruling, the dispute is likely to continue as the AfD has expressed its intention to challenge the decision. The party maintains that Senator Grote's statements were unfounded and constituted a breach of neutrality. The outcome of this ongoing dispute will have significant implications for the political landscape in Hamburg.
