Budget Office of Trump posts expenditure details following court mandate
The Office of Management and Budget (OMB) is now required to publish information on federal funding apportionments during President Joe Biden's administration, following a federal court order.
In August 2021, the decision to restore the web portal with the publication of wealth distribution data, previously shut down by the Trump administration, was made by the Biden administration. This move comes after the U.S. Court of Appeals for the D.C. Circuit on Aug. 9 denied the Trump administration's request to pause the lower court ruling.
The data about federal funding apportionments was taken down by Trump officials but is now being republished. This republishing was ordered by a federal court, following a lawsuit brought by Citizens for Responsibility and Ethics in Washington (CREW).
Sen. Patty Murray, D-Wash., stated that the data's return is a basic transparency requirement. She also emphasised that the OMB must ensure all hidden data is made public. Murray's calls for transparency come in light of recent media reports that the Trump administration used the apportionment process to pause and block funding for the Centers for Disease Control and Prevention and the National Institutes of Health.
In a March 29 letter to Sen. Patty Murray, OMB Director Russell Vought justified his decision to take down the data by stating that the requirement compelled the disclosure of sensitive, predecisional, and deliberative information. However, District Judge Emmet Sullivan ruled on July 1 that OMB must republish the website, stating that there is nothing unconstitutional about Congress requiring the executive branch to inform the public of how it is apportioning the public's money.
Circuit Judge Karen LeCraft Henderson, who was appointed by President George H.W. Bush, wrote in the Aug. 9 ruling that no president would allow a usurper to command the armed forces, and no Congress should be made to wait while the executive intrudes on its plenary power over appropriations and disclosure thereof.
CREW touted the return of the funding database in a fundraising email, highlighting the importance of transparency in government operations. The OMB decisions specify when appropriated agency funding becomes available, providing the public with crucial information about how their tax dollars are being used.
This restoration of the funding data on the OMB's website marks a significant step towards increased transparency and accountability in the executive branch's spending decisions.
