In a significant win for the client, Tripleye GmbH, a leading developer of Level 4 and Level 5 autonomous vehicle technology, FisherBroyles, LLP, a globally recognised distributed law firm, has secured a precedential decision in a trademark opposition proceeding at the USPTO TTAB.
The case in question, United States Patent and Trademark Office Trademark Trial and Appeal Board Opposition No. 91277359, was The Heil Co. v. Tripleye GmbH. The Board dismissed The Heil Co.'s opposition to the registration of the mark TRIPLEYE, which Tripleye GmbH had filed a Request for Extension of Protection on the Principal Register for in September 2021.
The Board compared and analysed the companies' marks, market presence, and goods and services using the DuPont factors. They determined the difference between the marks to be the most important factor in its decision, finding confusion with the registered mark 3RD EYE to be unlikely.
