The treaty was signed between the Federal Republic of Germany and the German Democratic Republic, two distinct entities that were about to become one. However, the treaty did not specify how the federal states developed after reunification.

Although the treaty did not provide specific information about the negotiators involved, it is known that Wolfgang Schäuble represented the Federal Republic of Germany, while Günther Krause represented the German Democratic Republic.
