In a landmark decision, the Regional Court of Frankfurt am Main has ruled that Apple Corporation's advertising of its smartwatches as "CO2-neutral" is misleading and violates competition law. The court's decision (file number 3-06 O 8/24) was made in favour of the Deutsche Umwelthilfe (DUH), a German environmental protection association, who filed the lawsuit.
The court's ruling is based on the overall impression the advertising creates on potential buyers of the Apple Watch. Consumers would assume that the advertised Apple Watch ensures CO2 compensation until around 2050, but the court found this assumption to be unfounded.
Apple's reforestation project in Paraguay, used for CO2 offset, only guarantees compensation until 2029 due to lease agreements. The lease agreements for 75% of the project area only last until 2029, and Apple could not prove they would be extended. Additionally, Apple's use of a Verra buffer account according to VCS standards does not provide adequate compensation for CO2 beyond 2029.
The "Carbon Neutral" logo is not perceived as a quality seal by consumers, but rather as an identification mark for products meeting Apple's CO2-neutral standards. The design of the logo does not create an impression of a guarantee for a certain quality and usability of the product. The lawsuit did not succeed in its criticism that the "Carbon Neutral" logo was misunderstood as a quality seal.
The court's decision does not specify any penalties for Apple at this time. However, the judgment will be available for retrieval in the near future at www.lareda.hessenrecht.hessen.de. This ruling marks the first time a German court has ruled on the advertising of a product's carbon neutrality.
The court's decision could potentially impact the advertising of other products claiming to be carbon neutral. As consumers become more environmentally conscious, accurate and transparent advertising regarding carbon neutrality becomes increasingly important. Apple has been ordered to refrain from advertising the Apple Watch as a CO2 neutral product. The decision is not final and can be appealed to the Higher Regional Court of Frankfurt am Main.
